Overview
Jenna McLane is an experienced insurance and regulatory attorney who focuses on helping clients develop and manage alternative risk programs, including the formation and ongoing operation of captive insurance companies. She advises on the creation of captives in various domiciles, along with risk retention and risk purchasing groups across all 50 states. Jenna handles risk retention group and risk purchasing group registrations nationwide, working directly with regulators on approvals, compliance questions, and ongoing regulatory requirements. She regularly consults on insurance matters such as licensing for agencies, producers, and brokers, the transaction of insurance nationwide, and captive mergers and consolidations. Jenna frequently helps clients navigate complex insurance arrangements and ensures compliance with insurance laws and program structuring requirements.
Jenna regularly conducts insurance policy reviews and provides guidance on claims and coverage issues, including reservations of rights and denials of coverage. She also drafts key legal documents, such as governing documents, investment management agreements, dividend policies, and investment policy statements, and assists with various corporate filings. Jenna works closely with offshore counsel and service providers to meet her clients' goals in these areas.
In addition to her insurance practice, Jenna has advised healthcare clients on regulatory compliance matters involving the Anti-Kickback Statute, Stark Law, HIPAA, and Medicare reimbursement requirements. She has also assisted with healthcare transactions, including mergers and acquisitions, corporate ownership changes, and corporate practice of medicine issues.
