Honigman’s Retail practice group, as a part of our nationally recognized top-tier Real Estate department, has more than 45 years of experience and is a leading provider of legal services within the regional and national retail real estate market. Our broad range of services includes development, construction, leasing, financing, real estate investment trusts (REIT), securities, environmental assessments, tax, tax appeals, and government incentives.
Our clients, located throughout the country, include owners, operators, landlords, tenants, and real estate service providers. The retailers we serve include regional mall developers, open-air shopping center developments, big-box and major tenants, power center developers, outlet centers, and single-tenant net-lease property developers.
Examples of retail projects that we have counseled include the Entertainment Walk (“E-Walk”) in Times Square (New York, New York); regional shopping centers, including Short Hills Mall (Short Hills, New Jersey); Cherry Creek Shopping Center (Denver, Colorado); MacArthur Center (Norfolk, Virginia); Beverly Center (Los Angeles, California); International Plaza and Bay Street (Tampa, Florida); The Gardens Mall (Palm Beach Gardens, Florida); and Tallahassee Mall (Tallahassee, Florida).
Our Retail practice group has extensive skills in shopping center leasing, regional mall operating agreements, reciprocal easement agreements, and construction development agreements. We also handle complex retail financing, including commercial mortgage-backed securities (CMBS). Our strong relationships with lenders and other parties involved in these transactions allow us to handle matters nimbly and efficiently.
Our retail attorneys hold leadership positions within the International Council of Shopping Centers (ICSC). They are frequent lecturers at the association’s national and regional law conferences and are at the forefront of the law related to commercial and retail leasing.
