Increase in Michigan Minimum Wage Leave, Paid Sick Leave Stayed Until February 2023

We previously reported here on the July 19, 2022, Michigan Court of Claims decision that would: (1) increase the state minimum wage to $12.00 per hour; (2) gradually eliminate the tip credit; and (3) expand Michigan’s paid sick leave requirements.  On July 29, 2022, the Court held that its decision would not take effect until February 19, 2023, so that employers and the State of Michigan have sufficient time to prepare for the changes.  In the meantime, the Court’s decision has been appealed to the Michigan Court of Appeals.

We will continue to monitor this situation closely, including as it is considered by the Michigan Court of Appeals.  Until then, employers should prepare for the new requirements to go into effect in February 2023.  If you have questions about these new changes and their potential effects, please contact your relationship attorney or one of Honigman’s Labor and Employment attorneys.
