Overview
Nicholas Burandt is a litigation attorney who focuses on complex commercial litigation matters. He has experience litigating cases involving breaches of contracts, mergers and acquisitions, shareholder disputes, civil fraud, antitrust violations, trade secret misappropriation, restrictive covenants, intellectual property infringement, environmental violations, professional liability, and other business disputes in various state and federal courts throughout the country. Nick has served as first and second chair in several high stakes trials, evidentiary hearings, and oral arguments.
Recently, Nick argued before the Illinois Appellate Court on a complex matter involving alleged breaches of a purchase agreement and share pledge agreement. Nick was successful in reversing the trial court’s decision. In another matter—involving over $100 million dollars in alleged damages—he conducted dozens of fact and expert depositions around the country and successfully argued multiple motions in limine to exclude expert testimony.
Nick brings a unique perspective to his cases having started his legal career as a law clerk for a federal district court judge. With that experience, he is positioned to assist clients at all stages of litigation.
Nick is also actively involved in the community. He sits on the Associate Board of the Union League Boys & Girls Clubs. He also assists college and law school students in mock trial programs around the country.

Representative Matters
Private Equity / Mergers & Acquisitions / Shareholder Litigation
- Served as lead counsel in successfully defending against temporary restraining order and dismissing case involving partners in joint venture for development of real estate.
- Managed case and assisted in negotiating an eight-figure settlement for private equity buyer in litigation in Delaware Chancery Court over fraudulent misrepresentations and breach of representations and warranties by private equity seller of marketing and advertising companies.
- Drafted and argued appellate brief in Illinois Appellate Court; successfully reversed order declaring that client lost ownership in shares of engineering company.
- Successfully reversed trial court’s grant of preliminary injunction requiring client to sell shares of business to other 50% shareholder.
- Argued and successfully defended against a motion to approve sale of engineering business.
Breach of Contract Litigation
- First-chaired trial in breach of commercial lease action and successfully obtained seven-figure judgment for real estate developer.
- Second-chaired eight-figure jury trial involving breach of a supply agreement; cross-examined expert witness and served as lead counsel on numerous arguments.
- Managed and negotiated six-figure settlements in dozens of cases for packaging manufacturer.
- Managed case and prepared for trial in dispute involving alleged breaches of a software service agreement; successfully negotiated settlement prior to trial.
Restrictive Covenants / Employment / Intellectual Property Litigation
- Obtained temporary restraining order in federal court against former employee for theft of trade secrets and breach of non-compete agreement; negotiated favorable settlement that led to termination of competing business.
- Obtained preliminary injunction in federal court against former employee for theft of trade secrets and confidential information.
- Assisted in obtaining preliminary injunctions against competing manufacturer that infringed client’s trademarks.
Antitrust Litigation
- Assisted in successfully drafting response to motion to dismiss in large antitrust dispute involving competing hospital systems.
- Assisted in drafting preliminary injunction to enjoin competing hospital system from imposing anti-competitive restraints on client.
