Overview

The attorneys in Honigman’s Arbitration, Mediation, and Alternative Dispute Resolution (ADR) practice group act as neutral arbitrators and mediators in commercial disputes. All are highly experienced litigators who appreciate that their role in ADR is to assist the parties in resolving their disputes fairly, efficiently and cost effectively. The attorneys in this practice have arbitrated and mediated a wide range of matters including, the sale of businesses, shareholder disagreements, supply arrangements, lending relationships, real estate development, and enforcement of non-competes.

Ad Hoc Arbitration and Mediation: In the most difficult cases, the parties frequently select I.W. Winsten to serve as their mediator and resolve their business disputes. Mr. Winsten brings to bear his broad experience, common sense and tenacious approach and creative strategies to settle even the most complex and contentious matters. Mr. Winsten has settled a wide range of matters as a mediator, including disputes involving the sale of businesses, shareholder disagreements, supply arrangements, lending relationships, real estate matters, and non-competes. In recognition of his expertise, Mr. Winsten is often also appointed as the mediator by the federal or state judge presiding over the matter.

American Arbitration Association: Paula Litt and Bea Swedlow are members of the AAA’s National Roster of Arbitrators and Mediators, which is made up of highly accomplished and respected legal and business professionals who have diverse experiences with a variety of commercial disputes. Members of the Roster receive comprehensive training from the AAA in managing the dispute resolution process fairly, efficiently, and economically. AAA arbitrators are bound by AAA standards of behavior and ethics to be fair and unbiased. Ms. Litt has served as an arbitrator in a wide range of matters that have gone to evidentiary hearing and award. She has chaired and participated in arbitral panels and served as a sole arbitrator.

The Chartered Institute of Arbitrators: Bea Swedlow is a Fellow of the CIArb, a leading professional membership organization representing the interests of alternative dispute resolution practitioners worldwide. Fellowship in the CIArb requires completion of written and oral examinations, as well as a peer interview. In addition to functioning as an international hub of excellence for the practice and profession of ADR, the CIArb acts as a global hub for practitioners, policy makers, academics and those in business, supporting the global promotion, facilitation and development of all ADR methods.

FINRA: Raymond Henney is a long-time FINRA approved mediator and arbitrator.  He is regularly asked to mediate customer and industry disputes because he provides an approach that is both evaluative and facilitative, which has been proven to be extremely successful.  Mr. Henney has also represented clients in hundreds of FINRA arbitrations.
