Overview

Margaret Greene is a real estate attorney who concentrates her practice exclusively on construction project planning and contracting and resolution of disputes during the construction phase. With more than 30 years of construction law experience, she has negotiated numerous design and construction contracts, understands the customary industry engineering and construction practices followed in the field, and possesses significant experience analyzing and resolving construction disputes and claims. Margaret is a Leadership in Energy and Environmental Design (LEED®) Accredited Professional with comprehensive knowledge of the LEED certification process and requirements.

  • Represents project owners on construction project planning and contracting and resolution of issues during the course of design and construction
  • Advises clients on resolution of construction claims, being familiar with typical claim theories and calculation of damages along with alternative dispute resolution practices and litigation proceedings
  • Reviews, negotiates, and drafts architect and engineer agreements, construction contracts, construction management agreements, design/build and turnkey agreements, purchase orders, equipment fabrication and installation contracts, consulting agreements, subcontracts, bidding documents, general and special conditions, development agreements, construction easement agreements, lease provisions, and other project agreements
  • Consults with project owners regarding planning and structuring of complex construction projects, selection of appropriate construction delivery models, and project administration procedures and issues
  • Possesses familiarity with cost implications of contractual allocation of design and construction risks, alternative contractual pricing formats, typical cost concerns and business practices of contractors and suppliers in bidding and performing contracts, project financing considerations, development incentives, and typical construction lending and disbursement arrangements
  • Knowledgeable regarding:
    • Critical path and other standard scheduling methodologies and practices
    • Standardized form contracts published by the American Institute of Architects, National Society of Professional Engineers, Associated General Contractors, and the Design-Build Institute
    • Customary industry indemnification, insurance, and bonding requirements and forms and surety requirements
    • Partnering arrangements
    • Building Information Modeling
    • Lean construction and Integrated Project Delivery
    • Construction Specifications Institute “Master Format” specifications system and American Institute of Architects “Masterspec” specifications format
    • Fast-track construction and construction phasing considerations
    • Industry standard practices regarding payments, schedule extensions, and pricing of extra work
    • Change-order procedures and documentation
    • Industry practices regarding substitutions
    • Shop drawing submittal procedures
    • Quality control testing and contract administration
    • Typical state statutory requirements regarding payments, indemnity agreements, licensing, and lien rights and forms
  • Represents and advises client regarding a very diverse range of projects, including hospitals and other medical facilities; industrial, manufacturing, and process facilities; bridge, highway, tunnel, and heavy construction; high-performance buildings, LEED-certified construction, and other green developments; alternative and renewable energy projects; residential and affordable housing developments; office, retail, and mixed-use developments; hotel, gaming, and casino facilities; existing facilities renovation; various public projects and public/private developments; museum projects; Native American tribal developments; environmental control, remediation, and demolition projects; water and wastewater treatment plants; and power plants
