Overview

Insurance is a vital asset of any business.  Our Insurance Recovery and Advisory practice seeks to maximize that asset for businesses, organizations and their individual insureds through coverage litigation, advice and advocacy, and insurance program reviews.

Coverage litigation:  We litigate coverage disputes regarding defense and indemnity for the full range of underlying claims, including directors and officers liability, management liability, professional liability, securities and antitrust claims, data breaches, catastrophic injuries, and first- and third-party property damage claims. We have represented insureds in coverage litigation in courts and arbitration across the country. 

Advice and advocacy:  We advise and advocate on behalf of insureds to secure coverage without resort to litigation.  We analyze policies and contractual insurance requirements, investigate and assess coverage for claims, and respond to insurer reservations of rights and coverage denials. We advise clients regarding steps they should take to preserve coverage.  We find creative approaches to securing insurance funding to resolve claims and cap our client’s exposure. We also serve as national coverage counsel for clients for all legal matters implicating insurance coverage arising in the course of their operations. 

Insurance program review:  We work with clients to prevent coverage problems before they happen. We provide in-house training to corporate law departments on coverage issues that recur frequently in their business. We review our clients’ insurance programs to determine whether they have adequate systems in place to verify that they are receiving the coverage they are entitled to under contracts with third parties, including contractors, commercial tenants, and borrowers. We advise clients on policy wording, enhancements, clarifications, and related issues in connection with renewals.
