Nationally-Recognized Medicare/Medicaid Authority Attorney Kenneth R. Marcus Rejoins Honigman Miller Schwartz and Cohn LLP

Honigman Miller Schwartz and Cohn LLP today announced that Kenneth R. Marcus has rejoined the firm as a partner in the firm's Healthcare Department.  Mr. Marcus brings an impressive reputation as a nationally-recognized authority in Medicare and Medicaid payment and appeal issues, including compliance matters. Mr. Marcus is also well versed and experienced in corporate transactional issues for health care clients.  He has successfully represented numerous hospitals in individual and group appeals before the Provider Reimbursement Review Board and federal courts, resulting in favorable judgments equaling hundreds of millions of dollars.

From 1995 until rejoining Honigman, Mr. Marcus was in private practice, focusing on healthcare and corporate issues.  He worked with Honigman from 1984 to 1995.  During his career, Mr. Marcus has handled a number of significant cases including Detroit Receiving Hospital v. Shalala and Hurley Medical Center v. Shalala.  The United States District Court for the District of Columbia also appointed Mr. Marcus among the four firms serving as Coordinating Counsel for the several hundred hospitals nationwide litigating the Medicare disproportionate share adjustment in the case of In Re Medicare.  In addition, he has enjoyed substantial experience as a transactional lawyer working with clients on hospital mergers, managed care contracting, integrated delivery system development, hospital-physician joint ventures, hospital-physician practice acquisitions and physician contracting.  In addition, he frequently advises clients in matters involving the Medicare and Medicaid Antifraud and Abuse Provisions, the Stark Act, and the Federal False Claims Act.

Mr. Marcus holds a leadership position with the Regulation, Payment and Accreditation Practice Group of the American Health Lawyers Association. He is also an Advanced Member of the Healthcare Financial Management Association and serves on the Advisory Board of BNA's Medicare Reporter.   Mr. Marcus is a past Chair of the Payment and Reimbursement Interest Group of the Health Law Section of the American Bar Association and a past member of the Board of Directors of the Eastern Michigan Chapter of the Healthcare Financial Management Association. He is the founder and inaugural Chair of that Chapter's Compliance Committee, for which he was awarded the Outstanding Committee Chair Award for 1999 and a Healthcare Financial Management Association national Helen Yaeger Award.  He also received the 2003 Ernest Laest Award from the Michigan Chapters of Healthcare Financial Management Association in recognition of his contribution to the education of the members of the Chapters. He is frequently sought after as a speaker and author on payment topics, including regular and ongoing appearances on the faculty of the American Health Lawyers Association's Annual Institute on Medicare and Medicaid Payment Issues.

Mr. Marcus received a BA from the State University of New York at Stony Brook (1971); a Masters in Health Services Administration from the University of Michigan (1978); and a Juris Doctor degree, Magna Cum Laude, Order of the Coif, from Wayne State University (1984).
