Stay of EEO-1 Pay Data Reporting Requirement

The White House recently halted the Equal Employment Opportunity Commission’s (EEOC) effort to collect pay data from employers as part of the EEO-1 reporting process.  Under President Obama, the EEOC issued a rule requiring employers to report annual pay data for employees, broken down by gender and race.  The rule would have required such reporting by March 2018.  Under President Trump, the Office of Management and Budget found the rule was burdensome and would pose privacy and confidentiality issues. 

For employers, EEO-1 reporting is back to business as usual.  The report will continue to include data on race, gender, and ethnicity by occupational category, but no pay data need be reported.  The 2017 EEO-1 Reports are due by March 31, 2018.
