Leigh Taggart is a partner and an intellectual property litigation attorney with more than 20 years of experience. He litigates patent, trademark, copyright, antitrust, and trade secret matters throughout the U.S. He handles matters in numerous industries, including medical device, pharmaceutical, automotive, silicon wafer, consumer products, and commercial jet engines. 

  • Aids clients in avoiding and resolving complex commercial disputes involving contract, antitrust, patent, trademark, copyright, and unfair competition issues
  • Served as general counsel and secretary for a manufacturer of a well-known branded consumer product sold in more than 70 countries


  • Advised C-level executives in U.S.- and foreign-based companies on mixed business and legal issues, usually involving $25 to $250 million in risk exposure or revenue potential
  • Argued patent, trademark, and copyright cases in U.S. District Courts in California, Texas, Delaware, and Michigan
  • Resolved numerous intellectual property and commercial disputes with amounts in controversy ranging from $5 million to several hundred million dollars
  • Worked in varied technologies, including cataract surgical instruments, intraocular lenses, brush seals for Boeing 777 jet engines, seats for private executive business jet aircraft, pharmaceuticals, wireless communication networks, and pistons for heavy-duty diesel engines
  • Ran five patent counterstrike suit after previous counsel lost $240 million patent judgment, resulting in settlement of all claims for $110 million plus substantial cross-licensing gains
  • Resolved $1 billion dollar patent claim without litigation using dispute resolution process established in earlier settlement agreement between parties
  • Settled patent case in Texas at pre-trial conference when well-known plaintiff’s lawyer significantly lowered demand to avoid trial
  • Briefed, argued, and won motions in U.S. district courts throughout the country, often against opponents represented by large national and international law firms
  • Presented arguments, evidence, and witnesses at preliminary injunction hearings in complex patent and trademark disputes
  • Argued a trademark case involving millions of dollars in alleged damages before the United States Sixth Circuit Court of Appeals
  • Argued a case presenting a patent law issue of first impression before the United States Federal Circuit Court of Appeals
  • Assisted in IP due diligence aspects of corporate transactions, including rush project for large semiconductor manufacturer involving review of thousands of licensing agreements
  • Performed freedom-to-operate studies and prepared IP opinions for numerous clients
  • Served as general counsel and secretary for a manufacturer of consumer durables; experience includes:

    • Negotiated solution to complicated dispute with European customer/distributor, resolving protracted litigation in the U.S. and the United Kingdom, while retaining customer/distributor on favorable terms
    • Represented company before U.S. and foreign government regulatory agencies and in federal court matters
    • Supervised inside/outside counsel in all legal matters, including protection of intellectual property rights, distributor termination, antitrust and unfair competition litigation
    • Traveled and worked extensively throughout European and Asian markets to solve mixed business and legal issues
    • Advised on issues relating to 10-Q and 10-K filings and Sarbanes-Oxley Act certification requirements
    • Advised management and parent company on issues related to the spin-off to a venture capital group and the subsequent re-purchase by the previous owner as well as various corporate financings
    • Conducted and supervised various internal investigations and compliance audits
    • Together with Logistics Manager, established second European distribution center (in Spain)
  • Counseled closely held businesses on corporate, partnership, and other issues, including choice of entity, incorporation, purchase and sale of assets, and transfer of ownership

  • Served as lead counsel in state and federal litigation, including commercial/contract disputes, employment discrimination, bankruptcy, creditors’ rights, personal injury, real estate, and trusts
  • Served as lead counsel in bench trials involving fraud, construction, and other issues
  • Conducted all negotiations and drafting on behalf of the FDIC in the workout of multimillion-dollar nonperforming real estate loan portfolio
