David Whitfield focuses his practice on energy law and natural resources extraction issues including transactions, regulations, administrative issues, and litigation. He has both state and federal experience, including a wide body of experience before the Michigan Public Service Commission and the Michigan Administrative Hearing System. Additionally, David has successfully defended numerous environmental permits, negotiated various long-term electricity and natural gas agreements, and counseled various real estate developers, mineral development clients, and other permittees in administrative environmental permit contested cases. David has:

  • Negotiated various long-term electricity and natural gas purchase and sale agreements for large industrial customers, as well as solar power programs for large industrial manufacturers.
  • Negotiated and developed novel and unique agreements for all aspects of carbon-offset-credit creation, certification, validation and marketing program for large manufacturer.
  • Substantial experience representing regulated utilities, independent power producers and customers before the Michigan Public Service Commission. This representation has and can include intervention into rate increase proceedings or matters related to pipeline regulation.
  • Performed transactional due diligence on energy related transactions.
  • Assisted clients with energy efficiency consultants and self-generation (natural gas cogeneration, wind and solar) projects.
  • Extensive experience representing permitees in contested case hearings related to various regulatory schemes, including a wide range of environmental permits and environmental notices of violation.
  • Drafted, negotiated and implemented various real estate agreements in connection with large-scale mineral development project in northern Michigan.
  • Served as General Counsel to northern Michigan oil and gas operator and working interest owner, consulting and advising on all business operations and legal issues related thereto.
  • Represented natural gas operators in relation to farmout agreements, area of mutual interest agreements, gas processing agreements, and various other operations agreements.
  • Negotiated oil and gas, solar, and other mineral leases on behalf of developers and landowners.
  • Successfully defended numerous environmental permits from challenges in administrative actions, including annual dam drawdown permits, waste water discharge permits, permits to mine, drilling permits, marina permits and various other environmental permits.
