Overview

Mr. Pitts is a litigation attorney who concentrates his practice on the defense of employers facing labor and employment challenges.  He defends individual and class action lawsuits at the state and federal level and he provides assistance during administrative agency investigations.  Mr. Pitts was a trial attorney for the U.S. Equal Employment Opportunity Commission (EEOC).  He has more than 30 years of litigation experience on behalf of public and private employers, having served as lead counsel in numerous high-stakes employment discrimination trials and complex litigation matters.  Mr. Pitts represents individual owners and corporations in a wide range of employment discrimination matters that encompass issues such as race, national origin, religion, disability and reasonable accommodation, sexual harassment, genetic information, gender, equal pay, pregnancy and age, as well as premises liability, whistleblower, disability accessibility and noncompete enforcement matters.  

  • Defends executive decision making concerning such issues as hiring, promotion, demotion, firing, pay and discipline
  • Provides experience driven practical advice to employers on issues arising under state and federal employment laws
  • Assists clients in finding cost effective solutions to employee disputes through alternative dispute options
  • Serves as a member of the firm's Board of Directors

Experience

  • Enforced arbitration provision in employment application, resulting in a state court lawsuit dismissal and resolution of a manufacturing company’s dispute with a former employee (2012)
  • Defended FedEx Ground against allegations of race harassment and race discrimination by human resources manager; obtained a no-cause jury verdict; Davis v. FedEx Ground Package System, Inc., No. 08-13512 (E.D. Mich. 2011)
  • Defended employer and individual supervisor against alleged egregious race harassment, national origin discrimination and retaliation; obtained a no-cause jury verdict; Syed v. Barbara Ann Karmanos Cancer Institute, No. 09-027694 (Wayne County Cir. Ct., 2010)
  • Obtained jury trial verdict for multi-party sexual harassment victims; on appeal, the en banc three-judge panel upheld the decision as to liability; EEOC v. Indiana Bell Tel. Co., d/b/a/ Ameritech Indiana, 214 F.3d 813 (7th Cir. 2000); 256 F.3d 516 (7th Cir. 2001)
  • Obtained jury verdict for class of female medical technologists denied equal pay; on appeal, the U.S. Court of Appeals for the Sixth Circuit upheld the principle that the jury’s finding of willfulness mandated liquidated damages for the victims; EEOC v. Herman Kiefer Hospital, 920 F.2d 355 (6th Cir. 1990)
  • Obtained damages via bench trial for class of female hospital custodians denied equal pay; EEOC v. Harper Grace Hospitals, 689 F. Supp. 708 (E.D. Mich. 1988)
