Overview

Mr. Crotty possesses extensive experience counseling employers on a broad range of employment and labor law matters, including discrimination, strategic workforce planning and noncompete agreements, and trade secret matters.  He also litigates employment, noncompete and trade secret claims before state and federal trial courts, appellate courts and administrative bodies. 

  • Providing preventative, forward thinking counseling and policies to help employers avoid liability for discrimination, harassment and retaliation
  • Defending employers in discrimination and other lawsuits brought under federal and state law, including the Fair Labor Standards Act (FLSA), the Family Medical Leave Act (FMLA), the Americans with Disabilities Act (ADA), the Persons with Disabilities Civil Rights Act, the Worker Adjustment and Retraining Notification (WARN) Act, the Whistleblowers Protection Act, the Uniformed Services Employment and Reemployment Rights Act (USERRA), Title VII and the Elliott-Larsen Civil Rights Act
  • Helping national and international companies establish employee operations in Michigan
  • Providing strategic labor and employment counsel regarding corporate mergers and acquisitions
  • Drafting and negotiating executive employment and severance agreements
  • Assisting with structuring both large- and small-scale workforce reductions

Experience

  • Represented automotive supplier before the United States Court of Appeals for the Sixth Circuit, which affirmed the dismissal of a USERRA claim based on a shortened contractual limitations period; Oswald v. BAE Industries, Inc., 2012 WL 1700704 (6th Cir. 2012)
  • Prevailed on appeal on behalf of an automotive die manufacturer; upholding the NLRB’s determination that an employee who falsified another employee’s involvement in a complaint to management may be lawfully discharged; UAW v. NLRB and Ogihara Corp., 514 F.3d 574 (6th Cir. 2008)
  • Served as primary labor counsel on numerous multi-million dollar acquisitions and divestitures of both unionized and non-union companies
  • Served as primary labor counsel regarding the dissolution of a Michigan insurance company and related workforce reductions
  • Obtained temporary restraining orders and preliminary injunctions against a variety of types of employees, including mortgage brokers, event emcees, engineers, and sales representatives based on restrictive covenant and trade secret claims
  • Defended and achieved favorable settlement of seven-figure sales representative commission lawsuit
  • Obtained multi-million dollar settlement in a vendor dispute with a municipal entity
  • Obtained peremptory reversal of adverse Wayne County Circuit Court decision; establishing that a casino was not liable when a valet driver engaged in an altercation with a customer; Gutierrez v. Greektown Casino, LLC, Michigan Court of Appeals Case No. 270393 (June 22, 2006)
  • Obtained summary disposition of former employee’s claims for breach of contract, race discrimination and sex discrimination; Ciaramitaro v. Greektown Casino, LLC, Wayne County Circuit Court Case No. 05-535989-CD
  • Obtained summary disposition of former employee’s Whistleblowers Protection Act claim based on the Garmon preemption doctrine; Bowers v. Greektown Casino, LLC, Wayne County Circuit Court Case No. 06-630590-CL
