Overview

Mr. Woolstrum is an environmental attorney who has been counseling clients in complex environmental legal issues since joining the firm's Environmental Law Department in 1991. He advises clients in matters involving environmental licensing and permitting, corporate acquisitions and mergers, real estate and commercial transactions, regulatory compliance, administrative and judicial proceedings, wetlands, and civil and criminal enforcement.  Mr. Woolstrum has significant experience in the areas of hazardous waste and solid waste regulations.  He is an active member of the Michigan Waste Industries Association (MWIA), a trade group that represents Michigan waste services companies.

  • Acts as environmental counsel in numerous corporate transactions
  • Negotiates the transfer of manufacturing facilities, asphalt production plants, hazardous and solid waste disposal facilities and other industrial facilities
  • Advises clients regarding environmental liabilities, land cleanup issues, permitting and other operational issues related to such transfers
  • Counsels industrial clients on a broad range of environmental compliance issues, including compliance auditing, reporting and self-disclosure, materials handling and disposal practices, land use and facility expansions
  • Serves as outside environmental counsel to several national waste management companies, including the operator of the only PCB landfill in the Midwest
  • Represents clients in enforcement actions brought by federal and state agencies
  • Assists clients facing significant civil penalties and onerous agency demands
  • Advises MWIA on legislative and regulatory matters affecting the solid waste industry

Experience

  • Negotiated substantial penalty reductions in two multimedia (Clean Air Act, Clean Water Act, and Resource Conservation and Recovery Act) enforcement actions brought by the U.S. EPA against waste disposal clients
  • Defended a publicly traded waste disposal company against efforts by the Michigan Department of Environmental Quality to force the closure of the company's Michigan facility in the wake of a federal criminal investigation
  • Convinced the Alabama Department of Environmental Management to withdraw its demand that a large automobile manufacturing facility enter into a hazardous waste corrective action order
  • Served as MWIA’s litigation counsel before the Michigan Supreme Court and the United States District Court regarding solid waste flow control legislation
  • Defended hazardous waste disposal company following major fires and explosions at two separate facilities
  • Negotiated a settlement with the U.S. EPA and MDEQ resulting in issuance of hazardous waste underground injection control permit and hazardous waste facility operating license
